TERMS & CONDITIONS

Terms and conditions relating to the sale of wine listed on this web site. Please note that these terms and conditions, as listed below, may change without notice at any time.

1. Listing of any wine or other product on this website does not constitute an offer of any kind. No guarantee is given that a wine listed is available since stocks change on a continuing basis. Vintages may vary from those listed. Prices listed are subject to change; for example, due to increases in duty or taxation or to currency fluctuations.

2. Orders for wine listed on this website may be given by telephone, mail, e-mail, fax or by clicking on any confirmation button on this website. On receipt of an order we will at our sole discretion either confirm or decline the order in whole or in part. If in part, we will make an adjustment to the price accordingly. We reserve the right to substitute in any order a product which, in our reasonable opinion, is of equal or greater quality.

3. The terms and conditions specified below which are in force on the date of receipt of an order which is confirmed will apply to that order.

4. There will be no contract between us, and an order will not be despatched, until payment in full by cash, credit or debit card or cleared cheque has been received by us. When placing an order you are deemed to have confirmed to us that you are at least eighteen years old. Should you not be, even if your order is confirmed, there will be no contract between us.

5. The prices given on this web site include tax and duty but not delivery charges. Delivery will be made only to an address within the United Kingdom. The charge for delivery will be quoted to you before the order is confirmed and the order will not be confirmed until you have approved the charge. Unless prevented from doing so by circumstances which are beyond our control, we will endeavour to despatch each order within fourteen days of receiving payment in full for it. We have no liability to you if an incorrect delivery address has been specified. If for any reason a delivery cannot be made to the address specified, the order will be returned to us and a charge will be made for its redelivery.

6. You have a statutory right to cancel your order within seven days of the date of delivery. You may do this by giving us written notice before the expiry of the seven day period. If you cancel your order in exercise of your statutory right, you must at your own expense, within seven days, return to our address below the wine or other product supplied, in full and in the condition in which it was delivered to you, failing which you must make it available for collection on request for which a charge will be made. Subject to this, if you cancel your order, on receipt of such wine or other product by us we will refund you accordingly.

7. If, despite 4. above, we despatch wine to you before payment is received, a contract between us will be established by the despatch and we will retain title to the wine until payment in full is received.

8. Risk in the wine will pass to you on its delivery to the address specified by you.

9. If any order delivered to you is in any way not satisfactory by reason of breakage, its condition or otherwise, or your order is incomplete or incorrect, you must within seven days of delivery notify us accordingly and make the goods in question available for collection and/or make arrangements for delivery of the balance of the order, as the case may be. Failing this, you will have no right to reject the goods or to have any further goods supplied in respect of that order.

10. We purchase wine only from sources which we believe to be reliable and make every effort to ensure that our storage facilities are appropriate. If wine is reasonably considered by you not to be in a suitably good condition we will, if we share your opinion, take back any unopened bottles and make an appropriate refund to you. However, we will not do this if, in our reasonable opinion, you have held the wine for long enough to enable it to deteriorate during your period of ownership or have not stored it in suitable conditions.

11. Notices to us under these terms and conditions must be given in writing and left at or posted to our address below or faxed or e-mailed to our fax number or e-mail address below. The notice is treated as being effective on the first business day on or (if not a business day) following which it is received by us.

12. These terms and conditions are governed by English law.
